Terms of Use
Bellaire Family Counseling Learning Site
Effective Date: August 25, 2026
These Terms apply to use of the learning site on or after August 1, 2026.
These Terms of Use ("Terms") govern access to and use of the Bellaire Family Counseling ("BFC," "we," "us," or "our") online learning site hosted on Thinkific, including free and paid digital downloads, courses, webinars, videos, worksheets, and other educational content.
By accessing, downloading, purchasing, enrolling in, or otherwise using content through the learning site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the learning site.
1. Eligibility
The learning site is intended only for individuals age 18 or older. By using the site, you represent that you are at least 18 years old and legally able to agree to these Terms.
2. Educational Purpose; No Clinical Relationship
All content on the learning site is provided for educational and informational purposes only. It is not psychotherapy, medical care, diagnosis, treatment, or individualized professional advice, and it should not be used as a substitute for care from an appropriately qualified professional.
Use of the learning site, purchase or download of content, participation in a webinar, or creation of an account does not establish a therapist-client relationship or any other clinical relationship with BFC or any BFC clinician.
The learning site must not be used to submit protected health information (PHI), communicate about clinical care, request treatment, report an emergency, or seek urgent mental-health assistance.
3. Accounts and Account Security
Some content requires creation of a Thinkific account. You agree to provide accurate information and to keep your account information current.
Your account is personal to you. You may not share login credentials, allow another person to use your account to access paid or restricted content, or use another person's account without permission.
You are responsible for activity occurring through your account to the extent permitted by law. Notify us promptly if you become aware of unauthorized access or misuse.
4. Free and Paid Content
BFC may offer free lead magnets, free courses or resources, paid digital products, courses, webinars, and other educational offerings. Availability, format, pricing, access terms, and included materials may vary by product.
5. Purchases, Payments, and Pricing
Prices are shown at the time of purchase and may change prospectively at any time. A later price change will not retroactively alter the price of a completed one-time purchase.
Payment information is processed by Stripe or another authorized payment processor. BFC does not directly receive or store full credit-card numbers.
You are responsible for charges you authorize, including applicable taxes or fees shown at checkout.
6. Refunds
Because digital content may be accessed, viewed, downloaded, or consumed immediately after purchase, sales of digital content are generally final once access has been granted.
BFC may, in its discretion, issue a refund or other remedy in limited circumstances, including duplicate charges, technical failures that prevent access, or other exceptional situations. Any such decision is made on a case-by-case basis and does not create an obligation to provide a refund in other cases.
Nothing in this section limits any refund, cancellation, or consumer right that cannot legally be waived.
If you believe you were charged incorrectly or experience a billing problem, contact BFC at [email protected]. We want the opportunity to review the issue and correct legitimate billing errors or access problems.
7. Access Duration
For products purchased individually rather than accessed through a subscription or membership, access is generally provided for the life of the product on the BFC learning site, while BFC continues to operate the applicable learning platform and the product remains technically and commercially available.
"Lifetime access" does not mean access for the purchaser's lifetime and does not guarantee perpetual hosting. Access may end if BFC closes the learning site or business, discontinues a product, changes platforms, loses the ability to host or license content, or continued access becomes technically, legally, or commercially impracticable.
If BFC intentionally discontinues the learning site or a paid product, BFC may, where practical, provide reasonable notice or an opportunity to download eligible materials, but does not guarantee that all content will be downloadable or transferable.
8. Future Subscriptions and Memberships
BFC may offer subscriptions or memberships in the future. If so, the applicable price, billing frequency, renewal terms, cancellation terms, and access rules will be disclosed at enrollment or purchase. Those product-specific terms will supplement these Terms.
9. License to Use BFC Materials
Unless otherwise stated in writing for a particular product, BFC grants you a limited, nonexclusive, nontransferable, revocable license to access and use purchased or downloaded materials for your personal, noncommercial use and, where applicable, for limited direct professional use as described below.
Personal Use
You may save eligible downloadable materials to your own devices and print copies for your own personal use.
Limited Professional Use
If you are a therapist, counselor, educator, coach, healthcare professional, or other professional, you may use eligible BFC worksheets or handouts directly with your own clients, students, patients, or participants as part of your professional work, provided that all BFC branding, copyright notices, attribution, and links remain visible and intact.
This limited professional-use permission does not allow you to resell, sublicense, broadly redistribute, publish online, upload to a shared resource library, membership site, course platform, or repository, distribute copies to other professionals for their use, remove BFC branding, or modify the material and present it as your own.
10. Intellectual Property
Except where otherwise indicated, the learning site and its content, including courses, videos, recordings, worksheets, handouts, text, graphics, branding, logos, design elements, downloads, and other materials, are owned by or licensed to BFC and are protected by applicable intellectual-property laws.
You may not copy, reproduce, republish, distribute, sell, license, upload, transmit, display, create derivative works from, scrape, or otherwise exploit BFC intellectual property except as expressly permitted by these Terms or by written permission from BFC.
11. Webinars and Recordings
BFC may offer live or recorded webinars through Zoom or another platform. Unless BFC expressly states otherwise, webinars made available for later distribution are intended to be one-way presentations.
Users may not record, screen-record, photograph, capture, reproduce, rebroadcast, publish, or redistribute a webinar or any portion of it without BFC's prior written permission.
BFC may record its own presenters and presentation materials for later distribution. BFC's intent is generally to avoid including attendee names, voices, video, chat messages, or other attendee participation in recordings intended for later distribution.
12. User Conduct
You agree not to:
copy, steal, misappropriate, or unlawfully exploit BFC intellectual property;
share account credentials or provide unauthorized access to paid or restricted content;
resell, redistribute, publicly post, or republish learning-site content except as expressly permitted;
impersonate another person or misrepresent your affiliation with any person or organization;
harass, threaten, abuse, or interfere with other users, BFC personnel, or service providers;
use the site for unlawful, fraudulent, deceptive, or harmful activity;
attempt to gain unauthorized access to accounts, systems, networks, or data;
introduce malware, malicious code, automated scraping tools, or other harmful or disruptive technology;
circumvent security, access, payment, or usage restrictions; or
use the site in a manner that materially interferes with its operation or other users' lawful access.
13. Course Progress, Quizzes, Surveys, and Certificates
Some courses may include progress tracking, quizzes, surveys, or certificates. Unless a specific offering expressly states otherwise, a certificate reflects completion of the applicable learning activity only.
A certificate does not represent professional licensure, certification, continuing-education credit, authorization to practice, or a determination of professional competency.
14. No Guarantee of Results
BFC does not guarantee any particular personal, clinical, educational, relationship, professional, business, or financial outcome from using the learning site or its content. Individual results depend on many factors outside BFC's control.
15. Third-Party Services and Links
The learning site may rely on or link to third-party services, including Thinkific, Stripe, Google Analytics, YouTube, Zoom, and other technology or service providers. BFC does not control third-party platforms and is not responsible for their availability, security, content, or independent terms and privacy practices.
16. Changes to Content, Features, and Availability
BFC may update, revise, replace, reorganize, suspend, or discontinue content, products, features, or portions of the learning site from time to time. We may also change technology providers or hosting platforms. We will honor applicable legal obligations and any express product-specific commitments that remain in effect.
17. Suspension or Termination of Access
BFC may suspend or terminate access to the learning site or specific content if we reasonably believe a user has violated these Terms, misused BFC intellectual property, shared unauthorized access, engaged in fraud or nonpayment, created security or operational risks, or engaged in harmful or unlawful conduct.
Termination for a material violation of these Terms may result in loss of access to purchased or free content to the extent permitted by law.
18. Disclaimers
To the fullest extent permitted by law, the learning site and its content are provided on an "as is" and "as available" basis. BFC does not warrant that the site will be uninterrupted, error-free, compatible with every device, or free from technical problems.
BFC does not warrant the accuracy, completeness, or suitability of educational content for every individual circumstance. Users are responsible for deciding whether and how to apply educational information and for seeking individualized professional advice when appropriate.
19. Limitation of Liability
To the fullest extent permitted by law, BFC and its owners, employees, clinicians, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of, inability to use, or reliance on the learning site or its content.
To the fullest extent permitted by law, BFC's aggregate liability for any claim arising from or related to a paid product will not exceed the amount you paid BFC for the specific product giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
20. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Subject to any nonwaivable rights under applicable law, disputes arising from or relating to these Terms or the learning site shall be brought in a court of competent jurisdiction in Harris County, Texas.
21. Changes to These Terms
BFC may update these Terms from time to time to reflect changes in the learning site, products, technology, business practices, or legal requirements. When material changes are made, BFC will update the effective date and may provide additional notice when appropriate.
22. Severability and No Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. A failure by BFC to enforce a provision does not waive BFC's right to enforce it later.
